Licence & Terms of Use

1. Licence Grant

RTO Consulting grants you a non-exclusive, non-transferable licence to download and use the RTO Compliance Document Pack (the "Materials") for your Registered Training Organisation's internal business purposes only.

Upon purchase and payment, you have the right to:

• Download all documents in the pack
• Edit and customise the documents for your RTO's use
• Add your own organisation's branding and details
• Use the Materials internally within your organisation
• Keep a permanent copy for your records

2. Permitted Use

The Materials may be used for:

• Developing your RTO's compliance framework
• Creating policies and procedures specific to your organisation
• Training staff and students
• Audit preparation and compliance documentation
• Internal record-keeping and governance

3. Restrictions

You agree NOT to:

• Resell, redistribute, or transfer the Materials to third parties
• Share access or provide copies to other organisations or individuals (unless they are employees of your RTO)
• Use the Materials for commercial purposes outside your RTO
• Publish, post, or make the Materials publicly available online
• Remove or alter any copyright, attribution, or licence notices
• Use the Materials as a basis for creating competing products or services to sell
• Use the Materials if your organisation is not a registered RTO with ASQA

4. Intellectual Property Rights

All Materials, including but not limited to policies, procedures, templates, checklists, and forms, are the intellectual property of RTO Consulting and remain protected by Australian copyright law.

RTO Consulting retains all rights to the original Materials. Your licence does not grant you ownership of the Materials, only the right to use them as permitted under these terms.

Once customised with your own details, the modified versions are your property. However, the underlying templates and structures remain subject to this licence agreement.

5. Liability & Disclaimer

While the Materials are designed to align with the Standards for RTOs (issued by ASQA), regulations change frequently. You are responsible for:

• Verifying that your use of the Materials complies with current legislation
• Obtaining legal or compliance advice specific to your circumstances
• Regularly reviewing and updating the Materials to reflect regulatory changes
• Ensuring your organisation maintains current and accurate compliance documentation

6. Limitation of Liability

To the maximum extent permitted by law, RTO Consulting shall not be liable for:

• Any direct, indirect, incidental, or consequential losses or damages arising from use of the Materials
• Loss of data, business, or revenue
• Regulatory fines, penalties, or sanctions resulting from use of the Materials
• Any issues arising from failure to customise or implement the Materials appropriately

In no event shall RTO Consulting's total liability exceed the amount you paid for the Materials.

7. Regulatory Compliance & ASQA Standards

The Materials have been designed with reference to the Standards for RTOs published by the Australian Skills Quality Authority (ASQA). However:

• ASQA standards are subject to change without notice
• Compliance requirements may vary based on your qualification scope and delivery mode
• You remain solely responsible for ensuring your organisation meets all regulatory requirements
• We recommend regular consultation with ASQA's official documentation and guidance

8. Payment & Refunds

Payment: Purchase of the Materials is a one-off payment. No subscription or ongoing fees apply. Payment must be made in full before access to the Materials is granted.

Refund Policy: As the Materials are digital and provide immediate download access, refunds are generally not available once purchased.

If you experience technical issues preventing download, we will work with you to resolve the issue. If we cannot resolve it, a refund may be issued at our discretion.

9. Confidentiality

You agree to keep your login credentials and access to the Materials confidential. You are responsible for any use of the Materials that occurs through your account.

Once you have customised the Materials with your organisation's information, that customised version is confidential to your organisation.

10. Termination of Licence

This licence is granted in perpetuity (for as long as you own a copy of the Materials). However, your licence will terminate automatically if you:

• Breach any provision of these terms
• Distribute or resell the Materials without permission
• Cease to be a registered RTO

Upon termination, you must cease all use of the Materials (except for archival copies of customised versions for your own records).

11. Changes to These Terms

RTO Consulting reserves the right to update these terms at any time. Updated terms will be posted on our website and take effect immediately. Continued use of the Materials after updates constitutes acceptance of the new terms.

12. Governing Law

These terms and conditions are governed by the laws of Australia and subject to the jurisdiction of the Australian courts.
