RTO Risk Assessment Tool

1.Ownership & copyright

The Tool, including its structure, wording, risk content, examples, formatting and branding, is the copyright and intellectual property of RTO Consulting. All rights are reserved. Nothing in these terms transfers ownership of any intellectual property to the Purchaser. The RTO Consulting name and logo are trade marks of RTO Consulting and must not be removed, altered or obscured.

2.Licence granted to you

On purchase, RTO Consulting grants the Purchaser a non-exclusive, non-transferable, perpetual licence to use the Tool internally within the Purchaser's own Registered Training Organisation for its own compliance, risk-management and self-assurance activities. Within that scope you may:

• open, complete, edit and adapt the Tool to reflect your own RTO's circumstances; and
• make internal copies reasonably needed for your own staff and management review.

3.What you may not do

Except with RTO Consulting's prior written consent, the Purchaser must not:

• sell, on-sell, sub-licence, rent, lend, share, distribute or otherwise make the Tool available to any third party outside the Purchaser's own RTO;
• publish, upload or post the Tool (in whole or in part) publicly or on any shared or online platform;
• use the Tool, or any part of it, to create, market or supply a competing product or a template, resource or service for other RTOs or clients;
• provide the Tool to consultants, contractors or other RTOs, except where they are engaged to work on the Purchaser's own RTO and agree to be bound by these terms; or
• remove, alter or obscure any copyright notice, branding or attribution.

4.Your responsibility for outputs & decisions

The Tool is a general risk-management template provided to assist RTOs to identify and consider common risks. It is not legal, compliance or professional advice and is not tailored to any particular RTO. The example impacts and strategies are illustrative starting points only.

The Purchaser is solely responsible for how the Tool is used and for all outputs, entries, ratings, decisions, controls and actions the Purchaser records or takes using it. The Purchaser must exercise its own judgement and, where appropriate, obtain its own professional advice, and remains solely responsible for its own compliance with the Standards for RTOs and all applicable laws and regulatory requirements. Use of the Tool does not guarantee any particular audit, registration or compliance outcome.

5.No warranty

The Tool is provided on an "as is" basis. To the maximum extent permitted by law, RTO Consulting makes no warranties or representations that the Tool is accurate, complete, current, or fit for any particular purpose, or that it covers every risk relevant to the Purchaser's RTO.

6.Limitation of liability

To the maximum extent permitted by law, RTO Consulting is not liable for any loss, damage, cost or expense (including regulatory findings, loss of registration, or indirect or consequential loss) arising from or connected with the Purchaser's use of, or reliance on, the Tool or its outputs. Where liability cannot lawfully be excluded, RTO Consulting's total liability is limited, at its option, to re-supplying the Tool or refunding the price paid for it.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.

7.Payment, GST & access

The full version price is $77 AUD, inclusive of GST. Payment is processed securely by Stripe, and a tax invoice is issued on purchase. As the Tool is a digital product delivered electronically, access is provided immediately and the purchase is generally non-refundable once the download has been accessed, except where a refund is required by law.

8.Governing law

These terms are governed by the laws of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of that State.
